Submission of documentation does not guarantee acceptance or approval of services.
5. Prohibited Conduct
TOPTIA maintains zero tolerance for fraud or dishonest conduct.
Clients may not:
• Submit false information.
• Alter documents.
• Forge signatures.
• Use another person’s identity.
• Misrepresent ownership.
• Conceal material facts.
• Submit fraudulent tax information.
• Submit fraudulent funding applications.
• Falsify income.
• Misrepresent employment.
• Create fictitious businesses.
• Request illegal services.
• Attempt to bypass legal or regulatory requirements.
• Encourage TOPTIA personnel to engage in unethical or unlawful conduct.
6. Refusal of Services
TOPTIA reserves the right to refuse, suspend, or terminate services whenever there is a reasonable belief that:
• Fraud has occurred.
• Fraud is suspected.
• False documentation has been submitted.
• Identity cannot be reasonably verified.
• Required documentation has not been provided.
• The requested service may violate applicable law.
• The client refuses to cooperate with reasonable verification requests.
• Continuing the engagement would expose TOPTIA or its clients to unreasonable legal, financial, reputational, or operational risk.
TOPTIA is not obligated to explain every factor considered when making a decision to refuse or discontinue services, except where disclosure is required by law.
7. Reporting Fraud
Where permitted or required by law, TOPTIA may report suspected fraudulent, criminal, or unlawful activity to:
• Law enforcement agencies
• Regulatory authorities
• Financial institutions
• Insurance companies
• Government agencies
• Payment processors
• Other appropriate organizations.
Nothing in this policy requires TOPTIA to investigate criminal activity beyond what is reasonably necessary to protect its business interests or comply with legal obligations.
8. Recordkeeping
TOPTIA may maintain records relating to:
• Client verification
• Identity verification
• Communications
• Submitted documents
• Transactions
• Service agreements
• Invoices
• Payment history
• Fraud investigations
• Internal compliance reviews.
Records may be retained as necessary to comply with applicable laws, contractual obligations, insurance requirements, audit requirements, and legitimate business purposes.
9. Employee & Contractor Responsibilities
Employees, contractors, volunteers, and representatives of TOPTIA are expected to:
• Follow company verification procedures.
• Protect confidential information.
• Report suspected fraud to management.
• Refuse requests that appear unlawful or unethical.
• Cooperate with internal compliance reviews.
• Maintain accurate documentation.
Failure to comply with these expectations may result in disciplinary action, termination of contracts, or other appropriate action.
10. Client Cooperation
Clients agree to cooperate with reasonable requests for verification and documentation.
Failure to cooperate may result in delayed services, suspension of work, denial of requests, or termination of the business relationship.
Clients remain responsible for payment of services already performed unless otherwise required by law or agreed to in writing.
11. Good Faith Compliance
TOPTIA may take reasonable actions in good faith to prevent fraud, protect confidential information, comply with legal obligations, or reduce business risk.
TOPTIA shall not be liable for delays, denials, or interruptions of service resulting from reasonable compliance or fraud prevention efforts.
Nothing in this policy limits any rights or obligations provided under applicable law.
12. Policy Violations
Violations of this policy may result in:
• Refusal of current services
• Cancellation of future appointments
• Termination of agreements
• Removal from vendor or client programs
• Collection efforts for unpaid balances
• Civil legal action where appropriate
• Reporting to appropriate authorities when required or permitted by law.
